Argentina's National Council of the Magistrature has transferred legal representation functions from the Ministry of Justice to its own Secretariat of Legal Affairs to enhance autonomy and streamline bureaucracy.

Buenos Aires, December 10 (NA) – The National Council of the Magistrature has decided to reorganize its Secretariat of Legal Affairs so that it progressively assumes representation and legal sponsorship in the judicial cases of the body and the Judicial Branch, a function that until now was exercised by the Ministry of Justice.

Resolution 225/2025, approved by the plenary session chaired by the head of the Supreme Court Horacio Rosatti, establishes that the Secretariat of Legal Affairs will now depend directly on the Plenary of the Council with technical independence, and will be divided into a Department of Legal Advisory and a Department of Litigious Affairs.

According to information from the Argentine News Agency, the measure aims to strengthen the autonomy of the body and responds to reasons of economic austerity and bureaucratic simplification.

As a priority, processes related to competitions, disciplinary proceedings, and those of greater economic or institutional relevance will be taken.

The resolution also instructs the development of an Information System for Judicial Management to concentrate the information of all the body's trials.

The Council argued that the training and experience acquired by the lawyers of the Secretariat in matters of judicial defense justify not assigning this task to a different body.

Transitionally, the representation by the Ministry of Justice will continue to be required while the Council gradually takes over the existing cases.
